
07 Aug Brown Altman Secures Comprehensive Zoning Approvals for Re-Constructed McDonald’s Restaurant in East Patchogue
Legal Team Delivers For National Brand With Local Approach and Approvals from the Town of Brookhaven

Founding Partner Keith Brown and Partner Matthew Ingber navigated this complex approval process, clearing the way for the demolition of the existing restaurant and the construction of a new 4,359-square-foot, one-story McDonald’s with a modernized design, accessory drive-through, and significant site and landscaping improvements.
The redevelopment site, located at the northwest corner of Montauk Highway (CR-80) and Sills Road (CR-101), required a change of zone from the J Business 2 Zoning District to the J Business 5 Zoning District, as well as a special permit. The Brookhaven Town Board granted these approvals and site plan approval on March 25, 2025, with special thanks to Councilman Neil Foley, who sponsored the Town Board resolutions.
In addition to Town Board approvals, the Brookhaven Board of Zoning Appeals held a public hearing and granted variance relief on May 28, 2025 to erect two new wall signs on the north and south building elevations and a ground sign height increase. Final site plan approval was issued by Town Planning Division on July 3, 2025, and the stamped approved site development plans, prepared by Bohler Engineering, were received two weeks later.
These approvals mark a critical milestone for McDonald’s Corporation as it continues to modernize its restaurants to better serve its customers and meet evolving operational standards.
